Drug Possession
You are an appellate judge hearing the appeal of a convicted offender who was given a 25-year sentence for possession with intent to distribute cocaine and transporting a controlled substance. The cocaine was found in the car she was driving, which was registered in her name but shared with her two roommates; she insists that the drug was not hers and she had no idea that she was transporting it. On the other hand, police surveillance showed her visiting known drug dealers intermittently, and she had several bags in her car that would have been too large not to notice. Answer the following questions:
a. Does this defendant have a case? Why or why not?
b. Which factors influenced your decision, and what other factors would help you make this decision?
